What To Expect From The Court Process
It may be necessary, for other personal and important reasons, to have the Court assist you to resolve your property matter.
When a Court appearance is required, documents will be prepared so that an application or response will be filed.
Full and frank disclosure of all assets and liabilities is essential to settle any property matter.
When all the information is made available, McCarthy Family Law will help you to make an informed decision as to the most appropriate and cost-effective way forward.
You will receive written advice from McCarthy Family Law at the commencement of your property matter along with a Costs Agreement and an estimate.
With your assistance, we will advise you how the Court will view the financial and non-financial contributions of each of the parties during the relationship. We will also advise you on the way the court will examine and identify any future needs.
As your matter progresses, you will continue to receive advice so that you always have the opportunity to make an informed decision based on the circumstances of your unique matter, and the appropriate and cost-effective options that may be suitable to settle your matter.
Should your matter not settle, we will continue to advise you on costs, outcomes, and strategies, until a final outcome is achieved.
With your assistance, we will prepare documents such as an Application or Response and file these at the Court. We will also seek information from other sources to assist the Court to make a determination.
Once your matter is before the Court, negotiations with the lawyer for the other party will continue where appropriate throughout the proceedings.
Should the matter progress, McCarthy Family Law will continue to offer you written advice throughout the process to assist you and the Court to resolve the matter with an outcome that is in the best interests of your children.
